Terms and Conditions

Welcome to the Eva+Avo Affiliate Program ("Program"). The Program is operated by Eva+Avo ("Company"), and is designed to allow affiliates to earn commissions by referring customers to the Company's website at partners.evaavo.com ("Site").

By participating in the Program, you agree to be bound by these terms and conditions ("Agreement"). If you do not agree to the terms of this Agreement, you may not participate in the Program.

Enrollment in the Program

To enroll in the Program, you must complete the application process at partners.evaavo.com. We reserve the right to reject any application in our sole discretion.
Commissions

As an affiliate, you will earn a commission on each sale that is made through your unique affiliate link. The commission rate is set by the Company and may be changed at any time in our sole discretion.

Commissions are paid on a monthly basis, approximately 30 days after the end of each month.

Commissions are paid via the option you selected at registration, and you are responsible for providing accurate account information in your affiliate account to recieve comissions.

Promotion of the Site

As an affiliate, you are authorized to promote the Site through the use of approved marketing materials, including banners, text links, and social media posts. You may not use any materials that have not been approved by the Company.

You may not engage in any of the following activities in connection with the promotion of the Site:

Spamming
Misrepresenting the Site or the Company
Engaging in any activity that violates any law or regulation

<strong>As an affiliate, it's crucial to note that you won't earn a commission if the customer discovers and applies a coupon code during their checkout, sourced independently from your website. Commission eligibility is limited to sales from users who haven't already visited Eva+Avo through other channels like Google Ads, Microsoft Ads, Facebook Ads, Organic Traffic, or any other source before your referral. In essence, your commission is tied to users exclusively brought in through your efforts, ensuring fairness and clarity in the affiliate program</strong>.

Termination

The Company reserves the right to terminate this Agreement at any time in our sole discretion. Reasons for termination may include, but are not limited to, violations of this Agreement, fraudulent activity, or inappropriate behavior.

Upon termination of this Agreement, all rights and licenses granted to you in connection with the Program will immediately terminate.

Limitation of Liability

The Company will not be liable for any damages or losses of any kind, including but not limited to direct, indirect, incidental, consequential, or punitive damages, arising out of or in connection with this Agreement or the Program.

Indemnification

You agree to indemnify and hold the Company and its officers, directors, employees, and agents harmless from any and all claims, damages, expenses, or liabilities arising out of or in connection with your participation in the Program.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without giving effect to its conflict of laws provisions. Any disputes arising out of or in connection with this Agreement shall be resolved in the state or federal courts located Miami, Florida, USA.

Entire Agreement

This Agreement constitutes the entire agreement between you and the Company with respect to the Program and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and the Company.

Modifications

The Company reserves the right to modify this Agreement at any time in our sole discretion. We will notify you of any material changes to this Agreement by posting the updated Agreement on the Site. Your continued participation in the Program following any such modification will constitute your acceptance of the modified Agreement. If you do not agree to any modification of this Agreement, you may terminate this Agreement by providing written notice to the Company.
